Subscription Policy

1. Subscription Plans & Purchase Methods

Laddrr offers subscriptions that can be purchased directly via our Website or through third-party app stores (Apple App Store, Google Play Store). Your billing relationship and legal rights depend on where you made your purchase.

  • Website Purchases: Billed directly by KM25 Sp. z o.o. (via Stripe/PayPal). These transactions are governed by this Policy.
  • In-App Purchases: Billed by Apple or Google. These transactions are governed exclusively by Apple's Media Services Terms or Google Play's Terms of Service. We do not have access to your billing details for these transactions.

2. Immediate Digital Delivery (Website Purchases)

For subscriptions purchased directly on our website:

  • Definition of Delivery: "Delivery" of the Service is deemed complete when our servers provision your account and send the confirmation email.
  • Proof of Delivery: Our system's technical logs (SMTP receipt) confirming the hand-off of the email to your provider constitute legal proof of delivery.
  • Access vs. Receipt: The Service is considered delivered once it is available to you. Your failure to receive the email (due to Spam filters) or failure to log in does not constitute non-delivery.

3. Refund Policy

A. Website Purchases (Direct)

General Rule: Unless otherwise required by applicable law, all website purchases are final and non-refundable.

  • EU/UK Right of Withdrawal Waiver: By clicking "Subscribe" (or "Pay"), you expressly consent to the immediate performance of the contract and acknowledge that you will lose your right of withdrawal from the contract once the digital content is provided or the service has started.
  • Australian Residents (ACCC Notice): Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in this policy alters your rights to a refund or replacement for a major failure of the service as defined by the ACL.
  • US/CA Residents: Refunds are not provided for partial billing periods or "accidental" renewals if you failed to cancel 24 hours prior to the renewal date.

B. App Store & Google Play Purchases

We cannot issue refunds for purchases made inside the App Store or Google Play.

  • Apple iOS: You must request a refund directly from Apple at reportaproblem.apple.com. Apple handles these requests at their sole discretion.
  • Google Play: You must request a refund via the Google Play Store > "Payments & Subscriptions" > "Budget & Order History".

4. Cancellation Policy

A. How to Cancel

You must cancel using the same platform you used to subscribe.

  • Website Purchases: Log in to your dashboard on laddrrapp.com or contact hello@laddrr.app.
  • Apple ID: Go to iPhone Settings > Apple ID > Subscriptions > Laddrr and tap "Cancel".
  • Google Play: Open Play Store > Profile > Payments & subscriptions and tap "Cancel".

B. Important Cancellation Rules

  • Uninstalling is NOT Cancelling: Deleting the Laddrr app from your device does not stop the subscription. You will continue to be charged until you explicitly cancel the billing agreement.
  • Effect of Cancellation: Cancellation stops future billing. You will retain access to the service until the end of your current paid billing period.

5. Service Availability vs. Usage

Your subscription fee pays for the availability of the license to access the Laddrr platform. Whether you choose to use the service is entirely up to you. Non-use of the service, or "forgetting" you subscribed, does not justify a refund or dispute.

6. Limitation of Liability

To the fullest extent permitted by applicable law (including Polish Civil Code Art. 449 and applicable consumer laws):

  • KM25 Sp. z o.o. is not liable for indirect, incidental, or consequential damages arising from your use of the service.
  • Our total liability for any claim arising out of or relating to these terms or the service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
  • Exclusion: This limitation does not apply to liability for intentional misconduct or personal injury where such liability cannot be excluded by law.

7. Dispute Resolution & Governing Law

  • Governing Law: These terms are governed by the laws of Poland.
  • US Residents – Class Action Waiver: If you reside in the United States, you agree that any dispute will be resolved on an individual basis. You explicitly waive your right to participate in a class action lawsuit or class-wide arbitration.
